45-Year-Old Sabahan Who Raped His Step Daughter Has Been Sentenced To 40 Years In Jail

On Tuesday, 27 March, a 45-year-old father was sentenced to 40 years in jail after he pleaded guilty to raping his step-daughter

Sessions Court judge Ainul Shahrin Mohamed, who handed the sentence after ruling that the prosecution had proven its case beyond reasonable doubt, also sentenced the man to 20 strokes of the rotan for raping his step-daughter twice.

According to The Star Online, the 45-year-old pleaded guilty to two charges under Section 376(3) of the Penal Code. The acts took place at a house in Menggatal.

He raped his step-daughter between December 2015 to February 2016. At the time of the first assault, the victim was aged only 12.

On the first charge under Section 376 of the Penal Code for rape, the accused was found guilty of having intercourse with his stepdaughter in Manggatal in December 2015 when the victim only 12 years old. He was also found guilty of committing the same offence under the same act against the victim in Feb 2016.

In meting out the sentence, judge Ainul ordered the accused to serve 20 years in jail and receive 10 strokes of the cane for each two charge, reported NST Online.

The accused will serve the jail sentences consecutively, with the first sentence to run from the day he was arrested on 26 April 2016

The 45-year-old pleaded for a lenient sentence saying it was his first offence, with his counsel PJ Pereira stressing that his client had been cooperative with police throughout his detention period, reported The Star Online.

However, prosecuting officer Chief Inspector Lim Swee Beng, who was standing in for Deputy Public Prosecutor Hafizah Zahidah Abdullah, asked the court to mete out a stern punishment saying he had committed a horrendous crime against the victim.

"This is a very serious offence and it will leave (the victim traumatised) regardless of her age," prosecuting officer Chief Inspector Lim was reported saying by NST Online.

During mitigation, Lim also added that a long custodial sentence would serve as a lesson not only to the accused but would act as a deterrent for would-be offenders.
