Zahid Hamidi says police will appeal against court's decision

“An appeal will be filed to ensure the police can charge them,” he said to reporters after attending a talk show on Bernama TV last night."

The police will appeal against the decision by a magistrate today to deny remand on three individuals who were detained to facilitate investigations under the Sedition Act 1948, said Home Minister Datuk Seri Dr Ahmad Zahid Hamidi.

What I want to say is that I have no intention to interfere in the business of the police, this is a normal procedure when a decision does not side with the police, so an appeal has to be made before the police can frame the charges.

The police today released three men who were detained for a probe under the Sedition Act 1948 and the Penal Code after a magistrate rejected requests for further remand.

Magistrate Norashikin Sahat rejected the remand application based on several grounds. Among others, she said the reasoning given by the police was too general to remand the trio. There was also no investigation done against the three since their arrest yesterday.

“We praise a very courageous magistrate. A brave magistrate has heard the legal arguments and decided that our detention is without basis,” said Chua after walking out of the lock-up with his lawyers, referring to magistrate Norashikin Sahat.

Police will now have to investigate them under a different offence, if they want to remand them further.

On 23 May 2013, Tamrin Ghafar, son of former deputy prime minister Tun Ghafar Baba, told a news portal that he had been arrested and was being taken to the Jinjang police station.

Haris, a human rights lawyer, is the second high-profile activist urging public action against Prime Minister Najib Razak's government for alleged massive electoral fraud in the May 5 general elections to be hauled up.

Tian Chua, in a tweet, said he was arrested at the low-cost carrier terminal (LCCT) in Kuala Lumpur, just before the security check.

In a second tweet, the Batu MP claimed he was informed that he was detained under Section 4(1) of the Sedition Act 1948.

Political activist Haris Ibrahim has just been arrested in Segambut while he was having his lunch. It is understood that he is being brought to the Jinjang Police headquarters lockup.

During the forum, Haris had called upon the public to take to the streets to bring down the Barisan Nasional-led government due to alleged cheating in the recently concluded 13th general election.
Meanwhile, Tian Chua, who also spoke at the forum, was arrested at the LCCT.

Two FMT journalists yesterday gave statements to the police with regard to their news reports on Haris Ibrahim’s vow to topple the government through a massive street rally.
FMT journalists Lisa J Ariffin and Alyaa Azhar were called to give their respective statements to the police.

Under Section 111 of the Criminal Procedure Code, with respect to the police officer’s power to require attendance of witnesses, both journalists gave their statements to ASP Ananthan Rajoo from the Dang Wangi district police station.

However, it is not clear if Haris will be investigated for suspected offences under the Sedition Act or under the Penal Code as student activist Adam Adli Halim, who also made the same call on a May 13 forum to topple Barisan Nasional through street rallies.

When asked on the arrest of Adam, Ananthan said the police had been monitoring the latter’s movements prior to the forum.
“He had been calling for a massive street rally even before May 13,” he explained.

Pakatan Rakyat distance themselves from ABU's call for a street protest

Anwar said calls for a mass street protest to oust the elected Barisan Nasional (BN) administration did not originate from PR but from affiliated non-governmental organisations (NGOs).

“These are just suggestions and it was never raised to the leadership and it is not something that is adopted by leadership,” he told a press conference after chairing a PR presidential council meeting here.

Karpal said that he could not accept the call for street protests despite agreeing that the recent general election was marred with irregularities.

“I know Haris is a good man. Probably he got carried away by anger on the fact that Najib (Tun Razak) is leading a minority government,” he said.

Although he commended Haris for opposing violent demonstrations, Karpal warned that a street protest may cause unrest if it was not handled properly.

Speakers at a forum held yesterday unanimously agreed that waiting for five years until the next
general election was too long, and vowed to overthrow BN this year through “force”.

“We will take to the streets and take over Putrajaya. If we really want to overthrow them, there is no other way. Democracy does not work,” Haris Ibrahim from ABU (Anything But Umno) told the 1,500-strong crowd here.

“The people cannot wait anymore. We don’t want to wait another five years. We will take the streets,” he added. “The decision to wait another five years or fight is not the right of Pakatan leaders, the results during the polls were not of Pakatan… but the rakyat’s,” he said.

The street rally is believed to take place as early as May 17 or May 18.

Haris Ibrahim says he's not advocating violence

Responding to those who associated the planned rally with a violent uprising, Haris claimed that no violence was planned. "We don't intend that at all," he said, adding that the movement was representing all Malaysians, including those in the security forces, their children and grandchildren.

Haris acknowledged that street rallies could turn violent due to the presence of agent provocateurs and if the police responded with high-handed actions.
However, he said this should not deter the people.

Asked on his confidence in amassing the targeted one million for the planned protest, Haris conceded that it was a tall order. The ABU leader added that the one million figure was possible.

Police says ABU is going against the King

OUTGOING Inspector-General of Police Tan Sri Ismail Omar said the alleged call by pro-opposition groups to overthrow the government through street demonstrations was seditious.

Speaking to the New Straits Times yesterday, Ismail said police would be investigating the statements made by several speakers at a forum held in the city on Monday.

"It is inciting people against the legally appointed government and also against the king. This is a serious statement and it is an offence."
