2 Foreigners Fined RM22,000 For Overstaying, Running Unlicensed Second-Hand Business In Johor

Police found expired passports and unlicensed trading activity during an inspection at a premises in Parit Raja.

Two Pakistani men were fined a total of RM22,800 by a magistrate's court in Johor after pleading guilty to immigration offences and operating an unlicensed business

The accused, identified as Bakht Bacha, 44, and Rahid Ali, 29, admitted to the charges before Magistrate Arun Noval Dass.

Both men were charged under Section 15(1)(c) of the Immigration Act 1959/63 for overstaying in the country beyond the permitted period.

Bakht faced an additional charge for operating a second-hand goods business without a licence, an offence under Section 6 of the Second-Hand Dealers Act 1946, punishable under Section 9 of the same Act.

The offences were committed at an unnumbered premises in Parit Kuari, Jalan Kluang, Parit Raja, at around 12pm on 2 April, reported the New Straits Times.

For the immigration offence, the court fined both men RM11,000 each, with a default of six months' imprisonment if the fine is not paid.

Bakht was also fined RM800 for the licensing offence.

According to the case facts, a police team inspecting the premises discovered that both men had overstayed in the country

Bakht's passport had expired on 6 January last year, while Rahid's had expired earlier on 23 December 2023.

Police also found that Bakht was carrying out second-hand trading activities without a valid licence, leading to the arrest of both men.

The prosecution was handled by Deputy Public Prosecutor Sharifah Natasha Syed Ahmad, while the accused were represented by lawyer Tan Song Yan.
