In a hearing at London's High Court which lasted less than a minute, District Judge Anne Aitken granted the couple a decree nisi - the first legal step to ending their 10-year marriage.

It is understood no money will change hands between the couple as they finalise the end of their marriage of 10 years.

ART collector Charles Saatchi says he is divorcing his wife, the television chef Nigella Lawson. It follows the publication of photographs which showed him with his hands around her throat at a London restaurant in June.

Mr Saatchi, 70, who accepted a police caution for assault, told the Mail on Sunday he had "clearly been a disappointment" to his wife. He said it was a "heartbreaking" decision for him.

"I feel that I have clearly been a disappointment to Nigella during the last year or so, and I am disappointed that she was advised to make no public comment to explain that I abhor violence of any kind against women, and have never abused her physically in any way," he said.

"This is heartbreaking for both of us as our love was very deep, but in the last year we have become estranged and drifted apart. The row photographed at Scott's restaurant could equally have been Nigella grasping my neck to hold my attention -- as indeed she has done in the past."

Ms Lawson, who has already moved out of the family's Chelsea home with her son Bruno, 17, declined to comment, even though her husband has repeatedly made statements to the Evening Standard newspaper, where he works as a columnist, to try to defend his actions as part of a "playful tiff".

53-year-old celebrity chef, Nigella Lawson, was spotted at a London restaurant with her husband, dining at Scott's in Mayfair restaurant, when they entered a heated argument.

The millionaire was later seen choking and squeezing Nigella's neck. Her eyes are transfixed as she struggles to prise away the powerful hand squeezing around her throat.

Saatchi launched a tirade of angry words. Four times he grasped her around the neck with Nigella looking powerless and petrified. At first he used only his left hand, then both.

At one stage he tweaked her nose then pushed both hands in her face. Twice Nigella jerked her head backwards as if in fear. Several times she nodded ­intently while the conversation became more and more heated.

Nigella then downed her glass of red wine in one gulp and began to talk, her voice trembling. She seemed to be trying to pacify her husband, placing a hand on his left wrist as it lay on the table. At that moment she leaned over and kissed his right cheek.

Bystanders also stood by, gawked and took photos of the attack. A couple on the adjacent table, who briefly chatted with Nigella earlier, turned round and gasped in alarm as they saw her in distress.

Many passers-by and diners who were dining at the restaurant, just sat and watched, but did not offer assistance to Nigella, as she was abused by Charles Saatchi.

It is not the first time the couple have been seen arguing publicly, but the first that has apparently involved him manhandling her.

The incident at the restaurant in London as not the first time the couple had been in a violent row. She admitted she and Saatchi have their fiery moments. 'I'll go quiet when he explodes, and then I am a nest of horrible festeringness.'

Police revealed they were likely to question the couple on the incident. Though no reports were made on the alleged abuse, police said they were aware of the pictures and will be questioning th couple.
