The accused, Mohamed Badruldin Mohamed, was charged with two counts before Magistrate Muhammad Iskandar Zainol
According to the charge paper, Mohamed Badruldin, who is unemployed, had murdered the baby boy at a low-cost flat of PPR Lembah Subang in Jalan PJU 1A/42, between 8am and 3.30pm on 27 April.
The first charge was framed under Section 302 of the Penal Code, which carries a mandatory death sentence.
No plea was recorded from the accused after the first charge was read to him before Magistrate Muhammad Iskandar as the case is under the jurisdiction of the High Court, reported Malaysia Gazette.
Meanwhile, the second charge was framed under Section 377C of the Penal Code for committing carnal intercourse against the order of nature without consent.
He pleaded not guilty to the sodomy charge, which carries a maximum of 20 years in jail and whipping.
An unrepresented Mohamed Badruldin was not allowed bail
Magistrate Muhammad Iskandarand has set 15 June for mention of his case.
Meanwhile, the accused only looked down, when he was brought to the courtroom this morning with his hands cuffed under police escort, in an attempt to avoid photographers from taking his photo.
