We earlier reported that a trailer driver was expected to be charged with murder for the fatal Segamat crash that killed three members of the same family

Muhamad Shafiq Salleh, 29, was formally charged at the Segamat Magistrate's Court today, 7 April, with three counts of murder under Section 302 of the Penal Code for the deaths of three family members in a road crash on 2 April along Jalan Johor Bahru–Seremban.

Section 302 of the Penal Code carries the death penalty, or imprisonment of between 30 and 40 years and a minimum of 12 strokes of the cane if the death penalty is not imposed.

Muhamad Shafiq faces three separate counts, one for each victim: S Palamiandy, 77, K Myakrishnan, 72, and S Sevendai, 62.

He nodded to indicate he understood the charges as they were read before Magistrate Amalina Johar.

No plea was recorded, as murder cases fall under the jurisdiction of the High Court.

The alleged offences took place at KM212 of Jalan Johor Bahru–Seremban at 3.50pm on 2 April

Muhamad Shafiq, who was driving a trailer at the time, is alleged to have ploughed into the rear of a van carrying a family of five.

The impact caused the van to veer into the opposite lane and collide with an oncoming lorry.

The three victims were pronounced dead at the scene.

Two surviving family members — Myakrishnan's grandchildren, P Hariharam, 22, and P Suguya, 18 — are receiving treatment at Segamat Hospital.

Muhamad Shafiq had tested positive for methamphetamine in a urine screening test conducted immediately after the crash

A separate charge under Section 15(1)(a) of the Dangerous Drugs Act 1952 for drug consumption will be filed once the pathology report is received.
