Cosmetics Brand In The Clear After MOH Allows It To Continue Selling Products

The local distributors of a China-based cosmetics brand, previously under scrutiny by the Health Ministry (MOH) for advertising their products as 'edible,' are now in the clear

The Health Ministry (MOH) has granted the cosmetics brand's appeal, allowing its two Malaysian distributors to continue selling the products, reported the New Straits Times.

However, the distributors have been warned that their licence to sell products in Malaysia will be revoked if they repeat the same misleading claims in the marketing and social media campaigns.

Health Minister Datuk Seri Dr Dzulkefly Ahmad said that the two distributors responsible for importing and selling the China-manufactured products in Malaysia submitted an appeal on 10 February.

The move followed a warning letter from the National Pharmaceutical Regulatory Agency (NPRA), which proposed revoking the notification of their products — a licence to sell them locally.

They had until 14 February to respond.

While authorities found that their advertisements misled buyers, all advertisements were removed before the 14 February deadline

According to Dr Dzulkefly, the distributors claimed that the advertisements and posts were created by their brand ambassadors and were beyond their control.

"After a further review of the safety risks involved, NPRA is satisfied with the corrective actions taken and has no objection to the appeals from the cosmetic notification holders to retain the notification for these products. However, a warning has been issued to both cosmetic notification holders, advising them not to repeat the mistake.

"NPRA will cancel the notifications without notice if the mistake is repeated," he said.
