Dad In Tawau Jailed 13 Years For Killing The Man Who Raped His 12-Year-Old Daughter

A father has been sentenced to 13 years in prison after pleading guilty to causing the death of a 33-year-old who had raped his 12-year-old daughter in Tawau, Sabah
The 30-year-old man, an Indonesian national, was initially charged under Section 302 of the Penal Code for murder, but the charge was later amended to an alternative charge under Section 304(a).
The accused, a father of six, pleaded guilty to the alternative charge under Section 304(a) of the Penal Code for culpable homicide not amounting to murder.
Judicial Commissioner Steve Ritikos handed down the sentence at the Tawau High Court today, 1 October, ordering it to take effect from the date of the man's arrest on 2 September 2024, the New Straits Times reported.
He will also be referred to the Immigration Department after completing his prison sentence.
Deputy public prosecutor Nur Nisla Abd Latif appeared for the prosecution, while the accused was represented by lawyer Jhessery P Kang.
His daughter told her mother what had happened
According to the facts of the case, the girl told her mother that she had been raped by the 33-year-old man while returning from a social gathering on the night of 31 August 2024.
After learning what had happened, the girl's father took a parang and went looking for the man, also an Indonesian national. He chased the victim to a nearby chicken coop and slashed him several times.
The victim died as a result of the attack.

Forensic evidence linked the man to the rape
An examination at Tawau Hospital found fresh tears to the girl's private parts.
DNA analysis by the Chemistry Department Malaysia subsequently found the victim's DNA on the girl's fingernail clippings. The DNA profile from semen found on her underwear also matched the victim's DNA.
The police later seized the parang allegedly used in the attack when the accused was arrested at his home on 2 September 2024.
