Heavily Pregnant Wife Denied Bail After Being Charged For Distributing 1KG Of Cannabis
The wife has been charged together with her 29-year-old husband.
A man and his heavily pregnant wife are facing the death penalty on charges of trafficking cannabis-type drugs yesterday, 6 October, in Ayer Keroh, Melaka
Aidil Shazreen Sanip, 29, and his wife, Maizurah Nurshafera Md Said, 30, were accused of distributing the drugs weighing 1.17kg in a Proton Persona in front of a house in Kampung Semabok JMMU, at 6.30pm on 29 September, reported Harian Metro.
The couple were charged according to Section 39B(1) of the Dangerous Drugs Act for drug trafficking, and punished under Section 39B (2) of the same Act, which provides the death sentence, upon conviction.
The husband and wife merely nodded and no plea was recorded when the charges were read out to them before Magistrate Mazana Sinin
Their lawyer, Noor Svetlana Mohd Noor Nordin, requested that the court use its discretion under Section 388 of the Criminal Procedure Code to release Maizurah Nurshafera on bail, citing the fact that the woman is seven months pregnant and due to give birth to her third child on 27 December.
The prosecution, however, raised an objection and cited Section 41B(1) of the Dangerous Drugs Act, which states explicitly that an accused person who commits an offence for which the death penalty is possible shall not be granted bail.
The case was transferred to the High Court after Mazana rejected the request to grant bail to the accused.
The court set 21 November for case remention and to obtain a lab report on the actual weight of the drug.
