M'sian Teacher Faces 6 Months' Jail For Caning An 11-Year-Old Student

A religious teacher who worked in a school in Kajang, Selangor has been sentenced to six months' jail for caning a student five years ago
According to Free Malaysia Today, 28-year-old Adib Abd Halim caned the student — then an 11-year-old boy — at a school in Bandar Seri Putra, Hulu Langat on 16 August 2017.
Adib voluntarily caused hurt to the victim because the boy refused to see him as instructed.
The boy suffered injuries to his legs and was admitted to hospital for two days.

Adib began his jail term today, 8 March.
He was also fined RM2,000 for his offence.
The trial was presided by a three-member Court of Appeal bench, chaired by Hanipah Farikullah and joined by P Ravinthran and Hashim Hamzah.
In their judgement, they said the High Court did not impose a sentence in accordance with the law.
Previously, the High Court revised a Magistrate's decision and sentenced Adib to a day's jail and fined him RM4,000, which he paid.
"We set aside the (High Court) sentence and restore the magistrate's ruling. We order the warrant of committal to be issued forthwith," Hanipah said in allowing the prosecution's appeal.
Hanipah said the High Court also "did not consider at all" the sentencing principle for the offence.

Earlier, Deputy public prosecutor Dhiya Shazwani Izyan Mohd Akhir submitted that Adib's punishment for the offence should not be fined more than RM2,000
"The High Court judge had misdirected himself in imposing a fine that exceeded what is allowed under the law," she said.
Adib's lawyer, Khairul Amin Abdullah, urged the judges to not change the jail term, contending that his client had lost his job. But he failed to convince the bench.
The Court of Appeal ordered the excess fine imposed on Adib to be returned to him.
