Court Orders Husband & Mistress To Pay Wife RM500,000 For Ruining 45-Year Marriage
The court ruled that the mistress had knowingly interfered with the marriage.
The Kuala Lumpur High Court has ordered a 38-year-old woman to pay RM200,000 in damages to a housewife, whose marriage of nearly five decades was broken up by the woman's actions
According to Berita Harian, Judge Evrol Mariette Peters also ruled that the husband, a 74-year-old man, must pay his 72-year-old wife a lump sum of RM205,000 in spousal support.
Additionally, both the husband and his mistress were ordered to pay RM50,000 each in legal costs to the wife.
Peters further ruled that the couple's matrimonial assets be divided equally, including real estate, gold, and stocks.
The ruling was made after the judge concluded that the man had committed adultery and the mistress had knowingly interfered with the marriage
According to the New Straits Times, during proceedings, the husband denied cheating on his wife, claiming he suffered from erectile dysfunction.
However, Peters found that while the evidence was circumstantial, "[it] painted a compelling and coherent narrative of an adulterous relationship between the husband and his mistress".
She also noted that the husband failed to provide any medical records to support his claim.
The husband also admitted that his mistress had spent the night at his home in Kampar, Perak, and shared a hotel room in Singapore, despite claiming they slept in separate beds.
The mistress also admitted that the man had stayed overnight at her condominium but claimed it was only for meditation sessions.
Messages between them also suggested that they were planning to have a child together through in vitro fertilisation (IVF).
Peters said she awarded the wife half of the matrimonial assets as she had sacrificed her career to care for the family
She said the wife, despite holding a diploma in business studies, gave up her professional aspirations to help manage her husband's business. She also cared for their six children and three grandchildren, as well as the husband himself during periods of illness.
"Her unwavering dedication to the welfare of the family was another critical consideration," Peters said.
The couple had been married since 1977. The wife discovered the affair when her husband confessed on 1 September 2022 that he had met another woman he intended to marry. The revelation led the wife to file for judicial separation the following month.
