E-hailing Driver Sentenced To Jail & Caning For Sexually Assaulting 17-Year-Old Student

An e-hailing driver was sentenced to 11 years in prison and five strokes of the rotan for sexually assaulting a 17-year-old male student on 3 October

According to the New Straits Times, Jack Samai, 37, faced three charges of physical sexual assault under Section 14(a) and (b) of the Sexual Offences Against Children Act 2017, which carries a penalty of up to 20 years in prison and whipping for each offence.

The court heard that the victim was returning home from tuition on the night of the incident

The SPM candidate had ordered the e-hailing service. After getting into Jack's car on Jalan Putera Indah in Batu Pahat, Johor around 10.10pm, the victim reported that Jack touched him inappropriately before stopping the car by the roadside.

Traumatised by the encounter, the victim did not attend school for a week and later confided in his teacher about what happened.

The prosecution was led by deputy public prosecutor Danial Munir, while Jack appeared without legal representation and pleaded for leniency before the Muar Sessions Court Judge Sayani Mohd Nor

The court sentenced him to five years in prison and three strokes of the rotan for the first charge, and three years of prison and one stroke of the rotan for each of the second and third charges.

His prison terms will run concurrently from the date of his arrest on 9 October.

The court also mandated the accused to undergo counselling and police supervision upon completing his sentence, in accordance with Sections 26 and 27 of the Sexual Offences Against Children Act.
