A 52-year-old tuition teacher has been sentenced to a total of 280 years in jail and 180 strokes of the cane after being convicted of raping his daughters in two separate cases
In the latest proceeding today, 21 July, the Tawau Sessions Court sentenced the man to 105 years' imprisonment and 70 strokes of the cane after he pleaded guilty to seven additional rape charges, reported New Straits Times.
Judge Ahmad Faizadh Yahaya ordered the accused to serve 15 years' imprisonment and receive 10 strokes of the cane for each charge, with the jail terms running consecutively.
The seven charges were framed under Section 376(3) of the Penal Code, which carries a maximum jail term of 30 years and a minimum of 10 strokes of the cane upon conviction
During mitigation, the prosecution urged the court to impose the maximum sentence, describing incestuous rape as among the gravest sexual offences
They said the victim was 16 years old when the first assault occurred, and argued that the accused had breached the trust between a father and daughter by betraying his duty to protect his child.
The accused told the court he regretted his actions, acknowledged his mistakes, and apologised to those affected.
"I am truly repentant and deeply regretful. I hope I am the last person to commit such an act, and I hope to be given a chance, if released later, to meet my children and family to ask for their forgiveness," he said.
Separately, in an earlier case concluded in April, Lahad Datu Sessions Court sentenced him to 165 years in jail and 110 strokes of the cane after he pleaded guilty to 11 rape charges involving his two daughters, who are now aged 22 and 25
He faced 11 charges under the same provision, with Judge Suhailla Selag ordering him to serve 15 years' imprisonment for each charge consecutively, reported Sinar Harian.
Combined with the latest case, the two sentences amount to a total of 280 years in jail and 180 strokes of the cane.
However, despite the sentence imposed, Section 288(1) of the Criminal Procedure Code caps the total number of caning strokes that can be carried out at 24.
The man was not represented by a lawyer in either case.
