Duo Claim Trial For Attacking Mamak Staff After Being Told Not To Take Food With Hands

The two men pleaded not guilty to the assault charges.

The two men who attacked employees at a mamak restaurant in Cyberjaya last week have been charged at the Sepang magistrates' court today, 21 March

The duo are said to be friends, named Elanggovan Muniyandi and Vengateswaran Malaisamy, both 51 years old, reported New Straits Times.

They were accused of committing the offences at Nasi Kandar Pelita Glomac, Cyberjaya, at around 7.30pm on 16 March.

Both of them face charges under Section 323 of the Penal Code for causing hurt, Section 427 for causing mischief by throwing plates belonging to the restaurant, and Section 509 for uttering obscenities at the employees.

As for Elanggovan, he faces an additional charge under Section 324 of the Penal Code for voluntarily causing hurt with a pair of tongs, according to Free Malaysia Today.

The two victims working at the mamak restaurant have been identified as Md Jahirul Hoque and Sarishkumar Jayakumar.

Elanggovan, who works as a tourist van driver, faces the heftiest possible punishment under Section 324 of the Penal Code, which carries a jail term of up to 10 years, a fine, or caning

Meanwhile, the punishment for Section 427 and Section 509 of the Penal Code that they jointly face has a maximum of five years imprisonment, or a fine, or both.

As for Section 323 of the same Act, it carries a one-year jail sentence or a RM2,000 fine, or both, upon conviction.

The duo pleaded not guilty to the charges before Magistrate Ayuni Izzaty Sulaiman.

During the hearing, their lawyer, Lingeswaran Andiappan, requested a lower bail for his clients, contending that Vengasteswaran only makes RM800 to RM900 a month as a taxi driver, while Elanggovan makes RM2,000 a month and has three children.

The court then set bail at RM8,600 for Vengasteswaran and RM11,600 for Elanggovan.

The Thursday incident went viral on social media as the brawl was captured in two separate videos

Speaking to SAYS, a witness said the duo started attacking staff members after one of them was told not to take a piece of fried chicken from the food display with his bare hands.

A one-minute-and-31-second video shows Vengateswaran repeatedly punching an employee, while Elanggovan picks up a utensil and shoves it at the employee's back.

The clip also shows the duo throwing plates at the victims at two separate intervals.
