Man Charged For Refusing To Wear A Mask & Shouting Expletives At People In Taman Desa

A man who was caught on video acting out and shouting "you wanna kena whack ah" after being asked to put on a mask at a nasi lemak stall in Kuala Lumpur has been charged in court

According to New Straits Times, J Shyamalan claimed trial at the magistrate's court in Petaling Jaya today, 22 July.

The 33-year-old was accused of violating Movement Control Order (MCO) standard operating procedures (SOPs) as well as insulting the modesty of 23-year-old Cherrilyn De Centino.

J Shyamalan was accused of committing both offences at Kedai Sepetang on Jalan Desa Bakti, Taman Desa about 10.30am on Sunday, 18 July.

However, he pleaded not guilty to committing the offences.

He was charged under Section 509 of the Penal Code as well as Regulation 17(1) of the Prevention and Control of Infectious Disease (Measures Within Infected Local Areas) (Movement Control) Regulations 2021.

J Shyamalan, who works as a businessman, is facing a maximum of five years' jail, a fine at the discretion of the court, or both upon conviction.

Deputy public prosecutor Wan Ahmad Hakimi Wan Ahmad Jaafar had asked the court to impose RM10,000 bail against the accused

However, J Shyamalan's counsel John Das pleaded for minimum bail.

"He needs to support his family and his business is deeply affected due to the current MCO," he said, as quoted by New Straits Times.

In the end, the court set RM4,000 bail with one surety and fixed 24 August for mention of the case.

The incident allegedly occurred after the stall owner and customer asked him to put on a mask in public.

However, not taking the advice, the accused shouted back, "What do you wanna do? Call police ah? Call lah, f--ker. What are you waiting for? F--ker, you wanna kena whack this morning?" and refused to calm down even after the stall owner intervened.
