Man Who Spit At A Grocery Store Staff For Asking Him To Follow CMCO SOP Fined RM3,000

A 47-year-old man from Taman Rasi Jaya, Ipoh has been fined RM3,000 for spitting at a grocery store employee on 30 November

The man, identified as M Gunalan, was fined at the Ipoh Magistrate's Court on Friday, 4 December after he pleaded guilty to uttering abusive words and spitting at Nor Asni Zilzawani Mohd Zahid.

During the incident at 8.40pm on Monday, the store employee in Lahat Baru 2 had asked him to comply with the standard operating procedure (SOP) set under the Conditional Movement Control Order (CMCO).

Magistrate Noor Azreen Liana Mohd Darus found Gunalan guilty of committing the offence to insult under Section 509 of the Penal Code

According to Bernama, deputy public prosecutor Nur Asmaniza Mohammad had asked the court to impose an appropriate penalty on the accused because his actions disturbed inter-racial sensitivity.

However, Gunalan's lawyer Robert S Gnanarajan asked for leniency, saying that the accused was no longer employed due to the COVID-19 pandemic and regretted his actions.

Under the offence, he could have been jailed for five years.

He, however, paid the fine of RM3,000 as imposed by the Magistrate's Court.
