Man Charged With 12 Months Of Prison After Stabbing Neighbour's Dog Using A Machete
The attack caused the dog's intestines to spill out and the beloved pet died a few hours later.
A man in Melaka has been sentenced to 12 months of prison after stabbing his neighbour's pet dog to death
According to Sinar Harian, Magistrate Suzana Mokhtar charged 38-year-old S Surais at the Jasin Magistrate court today, 11 November.
The man was found guilty of killing his neighbour's pet dog using a machete around 9.30pm on 5 November, at a home in Jalan Teratai, Taman Maju.
During the incident, the accused snuck into his neighbour's car porch before brutally stabbing the dog.
The attack caused the animal's intestines to spill out and the beloved pet died a few hours later.
District police chief DSP Mispani Hamdan told New Straits Times that the canine's owner heard her pet barking incessantly and peeked through her bedroom window to check on it.
He said, "Based on initial report, the woman's gate was unlocked. She was terrified to save her dog when she saw what the neighbour was doing it."
"The dog's intestines spilled out and was still alive before it succumbed to its injuries a few hours later," he added.
Photos of the injured dog were then posted on the Persatuan Haiwan Malaysia official Facebook account and they went viral.
The man was charged for two separate offences — killing an animal and trespassing his neighbour's home.
However, he pleaded for a lighter punishment instead of jail time.
The first offence is according to Section 428 of the Penal Code for mischief by killing or maiming any animal. The Penal Code states that whoever commits mischief by killing, poisoning, maiming, or rendering useless any animal shall be punished with either imprisonment for up to three years, a fine, or both.
Meanwhile, the accused was also sentenced according to Section 448 of the Penal Code for house-trespass. Those found guilty for this offence shall be punished with either imprisonment for up to three years, a fine which may extend to RM5,000, or both.
Utusan Malaysia reported that the man pleaded to be charged with a fine instead of being sentenced to prison and explained that he was once injured after being chased by the dog and falling off a moving motorcycle.
He also insisted that he himself is a dog owner.
However, deputy public prosecutor Hayatul Wirdah Mohd Yunos requested for jail time, considering the inhumane act done by the accused, as well as the fact that the animal was left to suffer in pain for five hours.
